Imam Bukhari's Jurisprudential Theory in Issues&Compilations of Imam Bukhari.part 4

 Part:4

  • Imam Bukhari's Jurisprudential Theory in Issues.

Imam Bukhari (may Allah have mercy on him) has a completely independent opinion from the "prevailing sects" on sub_ issues and Ijtihad issues.

In all four Sects (Maliki, Hanafi, Shafi'i and Hanbali), one's opposition or Adaptation depends not on prejudice or belief, but on argument. As is clear from reading Sahih Bukhari. The only source we have to know the Sect of Imam Bukhari is his book Sahih Bukhari. A study of this book shows that the doctrine of Imam Bukhari is a mirror of the following verse.
(Surah Al-A'raf verse no:3)

Translation:Follow what was revealed to you from your Allah, and do not follow besides Him.

Although some people have written that Imam Bukhari was Hanbali or Shafi'i. But this is against the truth. Imam Bukhari was also an absolute mujtahid, imam of jurisprudence and a pioneer of freedom of thought movement. As we illustrate with the following examples.

Example 1:
According to the Shafi'i sect, there must be forty people to perform Jumu'ah. While Imam Bukhari has established this chapter while rejecting them.

“Chapter: If the people turn away from the imam during the Friday prayer, then the imam’s prayer and whoever remains is permissible.”

Then he wrote a hadith under this chapter. The Prophet (peace and blessings of Allah be upon him) performed Jumu'ah with twelve men, while the people got up and left during Jumu'ah because of the arrival of the caravan.

Example 2:
According to the Hanafis, there are several conditions for paying Jumu'ah. According to the Hanafis, Jumu'ah is not permissible in ordinary villages. Imam Bukhari has written this chapter in refutation of this position.

Chapter: Friday in villages and cities.

Then Imam bukhari quoted a hadith that the first Friday after the Prophet's Mosque began in the town of "Jawathi" of Abdul Qays, which was in the area of Bahrain.

Example 3:
The Hanbali school of thought states that Friday is permissible before sunset. Imam Bukhari made it clear that this position is not correct, And established this chapter in their denial.

Chapter: The time for Friday(prayers) when the sun goes down.

Then Imam Bukhari narrated the hadith of Hazrat Anas under this chapter that the Prophet (peace be upon him) used to recite Jumu'ah after The sun goes down.

Example 4:
According to Malikia, it is not permissible to skip Friday prayers because of rain.
Imam Bukhari his not agree with this position. And in his book Bukhari Sharif, by establishing this chapter, he has denied ownership.

Chapter: It is permissible not to attend Friday prayers due to rain.

Under this chapter, Imam Bukhari has quoted the saying of Abdullah bin Abbas that although it is very important to recite Jumu'ah, but because of rain I do not want to put you in trouble, and you came to the mosque, lying in the mud.

Maulana Anwar Shah Kashmiri has written while clarifying the position of Imam Bukhari:
"My view is that Imam Bukhari has not imitated any sect in his book Sahih Bukhari.
Rather, he has taken the path of Ijtihad. Their understanding and insight has freely adopted what they have decided".

(Faiz-ul-Bari: Vol. 1, p. 335).

It is one thing for one mujtahid to agree with another mujtahid. This is not a proof of imitation of Mujtahid.
